GlobalJourneys markets and offers ‘experience’ based packaged tours. The following are the “Terms and Conditions” (hereinafter referred as “Agreement”) under which you (“You”) may use www.globaljourneys.in (hereinafter referred as “Website”) and its services related to travel and tour packages. Please read the following terms of this Agreement carefully. Your use of the website and booking of any services provided herein shall be governed by these this Agreement.

Use of Website
GlobalJourneys reserves the right to modify or replace this Agreement at any time and in its sole discretion. You are advised to check the website for the latest version of the terms and conditions prior to booking your vacation. Your continued use of the Website and services provided therein following the posting or effective date of any changes to the Agreement will constitute your acceptance of any such changes. If you do not agree to the changes, you must stop using the Website and services provided therein.
This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of the Website.
Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including minors, infirm, undischarged solvents are not eligible to use the Website. GlobalJourneys grants you a limited, non-transferable license to use this site in accordance with the terms and conditions of this Agreement. You may only use this site to make legitimate reservations or purchases and shall not use this site for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You shall not make reservation in the name of fictitious person. You agree that you will not use any device, software or routine that would interfere or be reasonably expected to interfere with the normal working of this site.
Prohibited Information
You are hereby notified to not host, display, upload, modify, publish, transmit, update or share certain prohibited information including but not limited to: (a) information which belongs to another person and to which the user does not have any right; (b) information which is grossly harmful, harassing, blasphemous, defamatory, obscene, libelous, invasive of other’s privacy, hateful or racial, disparaging or unlawful in any manner whatsoever; (c) information which is obscene, disrespects privacy or encourages money laundering or gambling or is otherwise unlawful in any manner; (d) information which infringes any patent, trademark, copyrights or other proprietary rights; (e) information which deceives or misleads the addressee about the origin of such information or communicates any information which is grossly offensive or menacing in nature; (f) information which personates another person; (g) information which contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit functionality of any computer resource.
We hold the right to terminate access or usage rights to the Website or any of the Website’s resources if the user does not comply with any of the rules, user agreement or privacy policy and to remove any information which is not in compliance with the our policies
Scope of Services
The service statements on this Website are for general description only. The information contained in this Website should not be viewed as an offer to sell or as a solicitation to purchase any of our services.
GlobalJourneys is a travel and holiday organizer. We do not own/control/operate any airline, cruise lines, trains, hotel or any other independent contractor or service provider in relation with services mentioned in this Website. Though we choose all the elements, independent contractors, service providers for your holiday with due care, however, we cannot assume responsibility for delay, deficiency or default if any in the services of such independent contractors, service providers, their management or staff leading to any injury/death/loss/damage to property or any such eventuality which do not fall within the scope of our normal selection and inspection process whilst engaging them. We are also not responsible for delay or deficiency in services of all independent contractors/service providers that may be borne out of any act or actions of co-traveler, co-participant which may result in You not availing some or all services on the tour as per their itinerary or the Website.

Health and Insurance
You are bound to inform us during booking of the tour if you have a medical condition that may affect your ability to enjoy and pursue the tour arrangements fully as per the itinerary mentioned in the Website. GlobalJourneys reserves the right where ever warranted to insist on medical fitness certificate any time prior to departure.
It is highly recommended that You acquire adequate insurance cover to secure your life, health and property as may be advised by your insurance agent to cover any eventualities associated with your overseas travel including health, accidental injury, loss, liability and the like depending on your assessment of your risk potential. Insurance if any, included in the tour price may be the standard travel care insurance policy provided by a third party insurance service provider and the scope of the cover may be limited in nature, the details of which shall be provided to you at the time of confirmation of your booking. You are advised to discuss your insurance needs directly with your insurance agent before proceeding on the tour and at your own cost procure any additional cover as may be advised. Please note, Insurance is the subject matter of solicitation, please read the terms and conditions of the insurance document carefully before finalizing your desired insurance cover.
Please note that you would have a direct contractual relation with the insurer and GlobalJourneys is only a facilitator. Therefore, it is advisable for you to check the accuracy and correctness of the insurance policy and in case of any error or lapse report the same to the Insurer directly and get the same rectified by them, as GlobalJourneys would not be responsible for the same.
Visa
You are required to hold valid travel documents viz. Passport and visas for international travel. You are responsible for making any necessary visa applications with complete set of documents required by the embassy/consulate within the stipulated period as advised by GlobalJourneys. In the event the visa application made by you or by GlobalJourneys on your behalf is rejected by the consulate due to either inadequate supporting documents or for whatever reason or where the visa could not be processed due to late submission of application by the you, GlobalJourneys shall not be liable for the eventuality and lead to forfeiture of booking amount paid and no claim whatsoever shall be entertained for the same. All cost, charges in respect of the said visa application shall be borne by you. Visa fees are non-refundable under any circumstances whatsoever. However due to rejection of visa or non-processing of visa application due to any circumstances if you are unable to travel on the tour originally booked, you will be subject to our Cancellation policy. GlobalJourneys is not a Visa service provider and cannot take any responsibility for visa assistance, information or guidance. All visas required for the tour including any transit or airport transit visas shall be your responsibility.
Amendments
a. GlobalJourneys reserves right to amend/alter any tour/holiday published in the itinerary subsequent to booking of the same by you, you shall have the option either to a) continue with the tour or holiday as amended or altered or b) accept any alternate tour or holiday which we may offer. In either case GlobalJourneys will not be liable to refund or compensate you for any consequential loss, damage or additional cost.
b. In the event that GlobalJourneys is unable to conduct a particular tour for whatever reason and you do not exercise any of the above two options, then it shall at its own discretion refund whatever amount collected towards the total cost of the tour without any interest after deducting actual expenses incurred on the services like visa charges, travel insurance, retention charges of the overseas suppliers and the like. You are not entitled to raise any grievance in respect of the same.
c. If as consequence of Force Majeure event (Acts of God, natural disasters, adverse weather conditions, fire, riots, acts of civil war, exercise of legislative, municipal or other authority, strikes, industrial unrest, lockdowns, destruction of any vessel, destruction or damage to the accommodation, craft or vehicle to be used in connection with a tour, insolvency or default of any carrier or service connected with the tour or any other event which is beyond our control), GlobalJourneys is obliged to alter, curtail, extend or cancel a tour, you shall not be at the liberty to claim any compensation or otherwise for any loss arising as a consequence of the said alteration, curtailment, extension or cancelation of the holiday.
d. In the event you miss a part / whole of the sightseeing tour or any such tour due to delay / indisposition or any other reason whatsoever on your part, then you will not be entitled to claim any refund.
Refund
GlobalJourneys reserves the right to determine the quantum of refund payable in case of cancellation or amendment of a Tour due to Force Majeure. Such refund would be based on various factors like the cancellation policies of suppliers like hoteliers, coach operators, tour operators, airlines and the like, and GlobalJourneys’ on the quantum of refund shall be final and binding on you.
Refund (if any) for amendments and/or cancellation will be paid directly to you by GlobalJourneys. It would take 45 days to process refund and 60 days if tickets are already issued. There shall be no refund if you do not or cannot utilize any service included in cost of tour like meals, rooms, excursions and the like nor can any refund be made for lost, mislaid or destroyed travel tickets or vouchers.
Cancellation
As the services to be provided are booked several months in advance, cancellation of such services earmarked for a particular departure results in the GlobalJourneys losing money depending upon the time of cancellation to the supplier. Therefore any cancellation of tour/services booked will attract cancellation charges as specified herein. If we book a third party product or service on your behalf (such as air tickets, accommodation, tours and activities), the terms and conditions and cancellation policy of such third party would be applicable in addition to the GlobalJourney’s Terms and Conditions. Any cancellation of tour/services has to be in writing clearly stating the reasons for cancellation. You expressly agree to the foregoing terms.
The following cancellation charges shall apply irrespective of the reason for cancellation. You understand and acknowledge that these charges are a genuine pre-estimate of the damages that we will suffer on account of cancellation. You agree not to dispute such deductions or to demand proof of actual damages. In the case of land package cancellation, fees will be payable by you as follows:

Note: Cancellation levy of hotel/airline/cruise line/ railway/transporter will also apply in addition to above. In case of any bookings being non-refundable, the cost of the booking amount will be added to the cancellation fee.
Limitation of Liability
GlobalJourneys shall under no circumstance whatsoever be liable to you or your for: 1) Personal injury, sickness, accident, loss, death, delay, discomfort, increased expense, consequential loss and/or damage on account of theft howsoever caused; 2) Temporary or permanent loss/damage to baggage/personal effects howsoever caused. In this condition the expression “howsoever caused” includes willful negligence on the part of any person; 3) Loss of baggage by the Airline/Cruise line/Surface transportation; 4) Failure on the part of airline to accommodate you despite having confirmed tickets; 5) Airline not allowing you to board the flight for reasons beyond the control of GlobalJourneys; 6) Damage or loss caused due to reasons beyond the control of GlobalJourneys (Force Majeure); 7) Refusal to grant Visa by the consulate / embassy.
No liability on the part of GlobalJourneys arising in any way out of this Agreement in respect of any tour, holiday, excursion facility shall exceed the total amount paid or agreed to be paid for the same and shall in no case include any consequential loss or additional expense whatsoever.
Disclaimer of Liability
UNDER NO CIRCUMSTANCES SHALL GLOBALJOURNEYS BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, RESULTING FROM ANY ASPECT OF YOUR USE OF THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE SERVICE, FROM INABILITY TO USE THE SERVICE OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION OR TERMINATION OF THE SERVICE. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVCES RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE WEBSITE OR ANY SERVICE OR ANY LNKS ON THE WEBSITE OF GLOBALJOURNEYS, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE WESBITE OR THE SERVICE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
Warranties
GlobalJourneys specifically disclaims all warranties with respect to this Website or your use thereof, express, implied, or otherwise, including without limitation, all warranties of merchantability and fitness for a particular purpose. GlobalJourneys shall not be liable for any damages resulting from the use or misuse of this site or the information on this site.
Arbitration and Governing Law
This Agreement shall be governed by the laws of Republic of India without giving effect t its conflict of law provisions, which is explicitly excluded. In the event of any dispute of whatever nature, arising under this Agreement, such dispute shall be settled through good faith negotiation among the parties. In case such dispute cannot be resolved by negotiation within 30 days such dispute shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act 1996. The place of arbitration shall be Mumbai, India. The parties shall mutually appoint a single arbitrator and the arbitrator’s decision shall be final and binding upon the parties. The proceedings of the arbitration shall be conducted in English and all of its submissions shall be writing. In case of the dispute requiring intervention of courts, courts in Mumbai alone shall have exclusive jurisdiction.
